Welcome to Toronty Ottawa. By accessing or purchasing from www.toronty.com (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). Please read them carefully.

By completing any purchase, you confirm that you have read, understood and agreed to these Terms and our Return & Refund Policy, including the requirement to return to our designated overseas warehouse and the customer’s responsibility for all return shipping, packaging and handling costs unless otherwise stated.

1. General Conditions

  • By visiting the Site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms.
  • We reserve the right to refuse service to anyone for any reason at any time, including suspected fraud or policy abuse.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our prior written permission.

2. Eligibility & Online Store Terms

  • You must be the age of majority in your province, state or country to use this Site.
  • You may not use our products for any illegal or unauthorized purpose.
  • You are responsible for maintaining the confidentiality of your account and for all activities under your account.

3. Products, Content & Availability

  • All products are subject to availability and may be withdrawn at any time.
  • We strive for accuracy in descriptions and images, but color/fit may vary due to device displays, manufacturing tolerances or batch differences. Size charts are indicative, not guarantees.
  • We reserve the right to limit quantities per order, per person or per household.
  • Prices can change without notice; pricing or typographical errors may be corrected, and we may cancel orders affected by such errors before shipment.

4. Orders, Verification & Payments

  • Provide current, complete and accurate purchase and account information. Orders may be cancelled if information cannot be verified.
  • Payments are processed via secure checkout providers. By submitting payment details, you authorize us to charge the order total, including taxes, duties, shipping and any selectable add-ons.
  • We may perform fraud screening and cancel or refuse any order at our discretion prior to shipment. You will be refunded if payment was captured.

5. Pricing, Taxes, Duties & Customs

  • Displayed prices typically exclude applicable taxes, duties and import fees unless expressly stated otherwise.
  • Customers are responsible for all customs duties, brokerage fees and taxes levied by the destination country.

6. Shipping, Delivery & Risk of Loss

  • Orders are fulfilled from partner warehouses, which may be outside your country.
  • Delivery times vary by location and carrier and are estimates only.
  • We are not responsible for delays caused by customs, carriers or events beyond our control.
  • Risk of loss passes to you upon carrier confirmation of delivery to the shipping address provided. We are not liable for theft after delivery confirmation.
  • You are responsible for entering a complete and correct shipping address. Address errors may result in delays, return-to-sender, additional fees or order cancellation.
  • Undeliverable, refused or unclaimed parcels may be treated as abandoned per carrier rules; associated costs may be deducted from any eligible refund.

7. Returns & Refunds (Summary)

  • We offer a 30-day return window from delivery date. Items must be unused, in original packaging, with tags attached.
  • All returns require prior approval and a valid RMA. Items returned without approval or to the wrong address are not eligible for refunds.
  • All returns must be sent to our designated overseas partner warehouse (currently located in Ningbo, China) or another facility we specify in your RMA instructions.
  • Customers are responsible for all return shipping, packaging and handling costs unless we shipped a defective or incorrect item.

8. Discounts, Promotions & Gift Cards

  • Promotions can change or end without notice. Unless stated, only one discount code per order.
  • Gift cards and most sale items are non-refundable; see our Return & Refund Policy for exclusions.

9. Pre-Orders & Backorders

  • Estimated ship dates are not guarantees and may shift due to production or logistics.
  • We may partially fulfill multi-item orders. Unfulfilled items remain on order unless you cancel before shipment.

10. Third-Party Services

  • We use third-party payment and logistics providers. Their terms and privacy practices apply in addition to ours.
  • We are not responsible for third-party sites linked from the Service.

11. User Content & Reviews

  • By submitting reviews, photos or other content to the Site or our socials, you grant Toronty a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish and display such content for marketing, analytics and operations, subject to applicable law.
  • You represent that you own or control the rights to any content you submit and that it does not infringe third-party rights.

12. Intellectual Property

  • All trademarks, logos, product names, text, graphics and designs on the Site are owned by or licensed to Toronty and protected by law.
  • Any unauthorized use is prohibited.

13. Warranty Disclaimer

Except where prohibited by law, the Service and products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

14. Limitation of Liability

  • To the maximum extent permitted by law, Toronty Ottawa is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site, Service or products.
  • Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

15. Indemnification

You agree to indemnify and hold Toronty and its affiliates, officers, agents and employees harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or violation of any law or third-party rights.

16. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including natural disasters, strikes, wars, pandemics, governmental actions, power or internet outages and logistics disruptions.

17. Changes to the Service & Terms

We may modify or discontinue the Service (or any part) without notice. We may update these Terms at any time; the updated date above reflects the latest version. Your continued use after changes constitutes acceptance.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of Belgium. Courts located in Belgium shall have exclusive jurisdiction, without prejudice to mandatory consumer protection rights in Canada, the USA or other jurisdictions that may grant you additional protections.

19. Severability & No Waiver

If any provision is unlawful or unenforceable, it will be deemed severed and will not affect the validity of remaining provisions. Our failure to enforce any right is not a waiver of that right.

20. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Toronty regarding the Service.
